Legislative challenges?

Terms and conditions regarding the employment relationship between the company and employees are regulated by the Labour Relations Act 65 of 1995, Basic Conditions of Employment Act 75 of 1997, Employment Equity Act 55 of 1998, Occupational Health and Safety Act 85 of 1993 and Skills Development Act 97 of 1998 just to mention a few. As extensions on the above acts Bargaining Councils have been established in certain sectors like MIBCO in the motor industry, MEIBC in the metal and engineering industry and NBCEI in the electrical industry. These councils have industry specific terms and conditions that are enforceable by law. Further the concept of procedural and substantive fairness plays a role in any type of dismissal, be it due to misconduct, incapacity or operational requirements. Should the employer fail to abide by the prescribed fairness a costly visit to either the CCMA or the relevant Bargaining Council is quick to follow.

Industrial Relations Support

What is IR Support?

Industrial Relations Support (IRS) can be seen as legislative insurance whereby specialised consultant assist the party responsible for Human Resources in the company to firstly ensure compliance and reactively offer support in all the relevant processes. IRS ensures contractual and legislative compliance and removes the responsibility of fairness from the HR representative to a dedicated consultant. This will mitigate risk of employment conflict and will remove the “bad guy” tag from the employer and place it on the independent consultant.
